HK immigration scheme operator sues Govt, Kilman, Kalsakau for “conspiracy to breach contract”Posted: February 17, 2016
A Hong Kong company, Vanuatu Registry Services Limited (VRS), is suing the Vanuatu Government, leader of the opposition Ishmael Kalsakau and his deputy Sato Kilman concerning citizenship / investment programmes. Conspiracy is alleged. The action, Civil Case no. 1089 (PDF, 1.2Mb), was lodged while Kilman was PM and Kalsakau was Attorney-General.
It is also suing PRG Consulting Limited in Hong Kong (which has conducted a Vanuatu Citizenship by investment programme), Vanuatu Migration Services Limited (the exclusive operator of the Real Estate Option Program – another citizenship through investment programme), Henry Tamashiro (Director of Immigration), and George Bogiri (former Director of Internal Affairs).
Vanuatu Registry Services Limited Hong Kong also owns the Elluk, Port Vila based company VRS (Vanuatu) Limited.
The Port Vila VRS is a direct representative of the Government of the Republic which it is now suing. It also happens to be Deputy Commissioner of the Vanuatu Financial Services Commission since 12 December 2008. As such it says it is able to use the VFSC’s official seal to certify incorporation, constitutions and Certificates of Good Standing. It sees itself as a properly professional agent for Asian and especially Chinese companies (being based in Hong Kong) wishing to establish an identity in the tiny South Pacific tax haven.
“VRS is a professional service organization established by veterans with many decades of experience in the international and corporate services industries,” their website says. They highlight the telecommunications links the company can provide for the Port Vila company rather than off-shore aspects of making business which is promoted more by VRS Hong Kong.
VRS is certainly taking on a lot in making a case against the government here and well-known government personnel. The case will be closely followed by the media.
